These Terms of Service govern your use of our service at Wout Salembier, except where we expressly state that separate terms (and not these) apply, and provide information about the Wout Salembier service, outlined below. All services provided by Wout Salembier will be referenced and named under Wout Salembier. By engaging our services, you agree to comply with the following terms. Please read these terms carefully before proceeding.
1.1 By using the services of Wout Salembier, you agree to these Terms of Service.
2.1 Wout Salembier provides web application and website development services, including support and warranty for his projects. 2.2 Support is provided for reasonable and common issues arising from the use of the delivered services.
3.1 Wout Salembier can register domain names for clients at an annual fee. 3.2 Clients may choose to provide their own domain names or have Wout Salembier manage them at the agreed-upon fee. 3.3 If a client wishes to transfer an existing domain to or from Wout Salembier's services, the client will be responsible for any associated costs, including transfer fees charged by domain registrars. 3.4 Additionally, Wout Salembier may offer domain leasing services where clients can lease a domain for a specified period. Terms and conditions for domain leasing will be outlined in a separate agreement.
4.1 Clients can decide to terminate Wout Salembier's services at any time and switch to another service provider.
5.1 Upon successful payment, full ownership of the project transfers to the client. 5.2 Wout Salembier retains the right to showcase the project as part of his portfolio on the website unless otherwise agreed with the client.
6.1 Wout Salembier provides a warranty for the delivered services for a specified period, as agreed upon with the client.
7.1 Wout Salembier is not liable for any damage caused by the use of the delivered services, except for intentional misconduct.
8.1 Wout Salembier and the client will jointly determine project deadlines and document them in writing in an agreement. 8.2 Wout Salembier will make reasonable efforts to meet agreed-upon deadlines but cannot be held liable for delays caused by factors beyond his control.
9.1 Standard support is provided for the delivered services as outlined in section 2 of these Terms of Service. 9.2 If the client requires additional support beyond the standard service, Wout Salembier may, at his discretion, charge additional costs for such support. 9.3 Rates for extra support will be communicated to the client in advance and must be agreed upon in writing before the additional support is provided. 9.4 Wout Salembier is not obligated to provide additional support if not agreed upon and paid according to the established rates.
10.1 Wout Salembier endeavors to ensure the integrity and security of client data during the use of his services. 10.2 However, the client acknowledges that no system is completely immune to technical failures, security incidents, or other events that may result in data loss. 10.3 Wout Salembier is not liable for any data loss occurring due to technical failures, security incidents, unauthorized access by third parties, or other unforeseen events. 10.4 It is the client's responsibility to regularly back up important data to minimize the risk of data loss. 10.5 Wout Salembier strongly recommends implementing adequate security measures, such as using strong passwords and security practices, to reduce the risks of data loss.
11.1 Both parties agree to maintain the confidentiality of sensitive information shared during the project.
12.1 These Terms of Service may be updated from time to time without prior notice. 12.2 It is your responsibility to review these terms periodically for changes. Your continued use of our services after the posting of any modifications constitutes acceptance of those changes.
13.1 These Terms of Service are governed by and interpreted in accordance with the laws of Belgium.
